Questions like these have been at the forefront of moral psychology ever since John Mikhail revived them in his influential work on the linguistic analogy and its implications for (...) jurisprudence and moral theory. Sport has become a significant part of the contemporary society culture. There has been developed a system of sciences dealing with sports. Philosophy figures prominently among them and it deals with aesthetic problems of sport. The problem of the aesthetic of sport is really of great importance as; first of all, it creates new fields of aesthetic activity and exerts aesthetic influence upon millions of people. Secondly, sports exert profound influence upon modern architecture, design, performing and fine arts, fashion and (...) lifestyle. Thirdly, sport has become one of important means of preservation and further development of traditions of national cultures and their aesthetic values. The development of sport is mainly determined by its aesthetic essence, therefore it is important to realize thespecific character of its content and avoid applying to it criteria of other kinds of aesthetic activity. The significance of the aesthetic aspect of sport is due to the fact that sport has contributed a lot to the development of human beings, their humanistic and aesthetic ideals, sensual image of a perfect man. The character of the contemporary society sport is complicated and controversial and therefore careful analysis of its content, of its structure and functions is necessary. (shrink)

Scientists from various disciplines have begun to focus attention on the psychology and biology of human morality. One research program that has recently gained attention is universal moral grammar (UMG). UMG seeks to describe the nature and origin of moral knowledge by using concepts and models similar to those used in Chomsky's program in linguistics. This approach is thought to provide a fruitful perspective from which to investigate moral competence from computational, ontogenetic, behavioral, physiological and phylogenetic perspectives. In this article, (...) I outline a framework for UMG and describe some of the evidence that supports it. I also propose a novel computational analysis of moral intuitions and argue that future research on this topic should draw more directly on legal theory. (shrink)

The aim of the dissertation is to formulate a research program in moral cognition modeled on aspects of Universal Grammar and organized around three classic problems in moral epistemology: What constitutes moral knowledge? How is moral knowledge acquired? How is moral knowledge put to use? Drawing on the work of Rawls and Chomsky, a framework for investigating -- is proposed. The framework is defended against a range of philosophical objections and contrasted with the approach of developmentalists like Piaget and Kohlberg. (...) ;One chapter consists of an interpretation of the analogy Rawls draws in A Theory of Justice between moral theory and generative linguistics. A second chapter clarifies the empirical significance of Rawls' linguistic analogy by formulating a solution to the problem of descriptive adequacy with respect to a class of commonsense moral intuitions, including those discussed in the trolley problem literature originating in the work of Foot and Thomson. Three remaining chapters defend Rawls' linguistic analogy against some of its critics. In response to Hare's objection that Rawls' conception of moral theory is too empirical and insufficiently normative, it is argued that Hare fails to acknowledge both the centrality of the problem of empirical adequacy in the history of moral philosophy and the complexity of Rawls' approach to the problem of normative adequacy. In response to Nagel's claim that the analogy between moral theory and linguistics is false because whatever native speakers agree on is English, but whatever ordinary men agree in condemning is not necessarily wrong, it is argued that the criticism ignores both Rawls' use of the competence-performance distinction and the theory-dependence of the corresponding distinction in linguistics. In response to Dworkin's claim that Rawls' conception of moral theory is incompatible with naturalism and presupposes constructivism, it is argued that Dworkin's distinction between naturalism and constructivism represents a false antithesis; neither is an accurate interpretation of the model of moral theory Rawls describes in A Theory of Justice. The thesis concludes by situating Rawls' linguistic analogy within the context of broader debates in metaethics, democratic theory, natural law theory, and the theory of moral development. (shrink)

My primary aims in this paper are to explain what exploitation is, when it’s wrong, and what makes it wrong. I argue that exploitation is not always wrong, but that it can be, and that its wrongness cannot be fully explained with familiar moral constraints such as those against harming people, coercing them, or using them as a means, or with familiar moral obligations such as an obligation to rescue those in distress or not to take advantage of people’s vulnerabilities. This paper discusses the role of Law and Legal Thinking in Critical Theory with specific reference to the arguments that Michael Hardt and Antonio Negri offer in their book Commonwealth. The core idea is that Critical Theory is no less radical, but much more concrete, when it is performing not only an external, but also an internal critique of the Law. It shows that the role of the law in critical theory emerges as a problem when the latter claims that (...) ‘there is no outside’ and that ‘the legal base of the system structures our lives.’ It then discusses optimistic and pessimistic strategies to overcome the problem, and argue for a demanding strategy which consist in articulating the external and the internal critique of the law. To make this point, the paper goes back to the epistemic context in which critical attitudes are deployed (the ‘Conflict of the Faculties’), describes the four theoretical moves constitutive of the historical moment in which, at the end of the 18th Century, modern law as we know it was conceived of and founded; and sketches the key moments of the history of the internal critique of the law. It then illustrates the demanding strategy with examples taken from the field of Intellectual Property, and concludes that the Law is malleable and open enough to allow the thinking and practicing of radical alternatives from within the legal system and also that alternatives spoken in the language of the law are no less radical, but certainly, more concrete than others. The question of the world in itself — the world beyond its correlation with experience in the broadest sense — is one of the sore points of phenomenology and becomes especially acute in the light of modern discussions around correlationism. These discussions, in one way or another, make phenomenology come around to the classical distinction between the phenomenon and the thing-in-itself, with the help of which Kant outlines the field of ethics as a special world lying on the other side (...) of the correlation of knowledge and object constitutive for nature. Philosophy deals with the thing-in-itself in the proper, positive sense of the word, not as phenomenology (transcendental philosophy, which reveals the correlation of knowledge and reality in the world of phenomena and the futility of attempts by theoretical reason to know anything beyond phenomena), but as a critique of practical reason. The article attempts to consider the opposition of the thing-in-itself and the phenomenon in the context of the criticism that Kant’s practical philosophy is subjected to in Hegel’s The Phenomenology of Spirit and to explicate the arguments that this criticism makes available to phenomenology for rethinking the problem of Ding an sich and the ethical dimension of the epoche. The first part of the article examines the Hegelian analysis of the main contradiction contained in the Kantian opposition of duty as something that is in itself, and nature as a phenomenon (this opposition forms what Hegel calls the moral worldview): duty does not depend on nature and therefore does not need natural (phenomenal) realization in actions, but at the same time, duty is nothing but the necessity of actions and, consequently, the necessity of a phenomenon. This contradiction, as Hegel shows, leads to the disintegration of the moral worldview and, thus, turns into the sublation of the absolute separation of duty (thing in itself) and nature (phenomenon). The restitution of the difference between the moral an sich and the phenomenon within conscience — a phenomenon that arises as a result of the destruction of the moral worldview — turns into a new paradox, which demonstrates that the thing-in-itself (ethical good), since it is freed from the phenomenon, is not only unreal, but also turns into its own opposite. The paradox consists in the fact that the consciousness of duty, taken in its independence from the phenomenal realization in actions, becomes evil itself, turning to hypocrisy in the moral judgment about other people’s actions. In the second part of the article, the significance of the Hegelian critique of Kant’s practical philosophy for the phenomenological destruction of the difference between the thing-in-itself and the phenomenon and the problematization of the ethical dimension of the phenomenological method is explicated. Tracing the naive origins of this difference in the natural attitude and their transformation in Kantian philosophy, the author tries to consider the sublation of the opposition of the thing-in-itself and the phenomenon in the field of ethics as one of the possible paths to phenomenology. It is shown how the necessary relation of the supra-worldly an sich with the situational nature of its phenomenal realization in actions calls into question the possibility of a phenomenological epoche. The author also seeks to demonstrate that the problematization of the difference between the thing-in-itself and the phenomenon does not turn phenomenology into a system in the Hegelian sense. When is it immoral to take advantage of another person for one's own benefit? For some, such as Ruth Sample, John Roemer, and Will Kymlicka, the answer at least partly depends on whether what one takes advantage of is the fact that this person is, or has been, the victim of injustice. I argue, however, that whether person A wrongly exploits person B is wholly unrelated to whether A takes advantage of the fact that B is, or was, the victim (...) of injustice. I also develop a positive account regarding which personal attributes one should not exploit for personal gain. (shrink)

This article argues that the key elements of the prima facie case of harmful battery may form critical building blocks of moral cognition in both humans and nonhuman animals. By contrast, at least some of the rules and representations presupposed by familiar justifications to battery appear to be uniquely human. The article also argues that many famous thought experiments in ethics and many influential experiments in moral psychology rely on harmful battery scenarios without acknowledging this fact or considering its theoretical (...) or empirical implications. The unifying factor in all these studies is goal-directed harmful contact, inflicted without consent or justification. (shrink)

Could a computer be programmed to make moral judgments about cases of intentional harm and unreasonable risk that match those judgments people already make intuitively? If the human moral sense is an unconscious computational mechanism of some sort, as many cognitive scientists have suggested, then the answer should be yes. So too if the search for reflective equilibrium is a sound enterprise, since achieving this state of affairs requires demarcating a set of considered judgments, stating them as explanandum sentences, and (...) formulating a set of algorithms from which they can be derived. The same is true for theories that emphasize the role of emotions or heuristics in moral cognition, since they ultimately depend on intuitive appraisals of the stimulus that accomplish essentially the same tasks. Drawing on deontic logic, action theory, moral philosophy, and the common law of tort, particularly Terry's five-variable calculus of risk, I outline a formal model of moral grammar and intuitive jurisprudence along the foregoing lines, which defines the abstract properties of the relevant mapping and demonstrates their descriptive adequacy with respect to a range of common moral intuitions, which experimental studies have suggested may be universal or nearly so. Framing effects, protected values, and implications for the neuroscience of moral intuition are also discussed. (shrink)

In this comment on Joshua Greene's essay, The Secret Joke of Kant's Soul, I argue that a notable weakness of Greene's approach to moral psychology is its neglect of computational theory. A central problem moral cognition must solve is to recognize (i.e., compute representations of) the deontic status of human acts and omissions. How do people actually do this? What is the theory which explains their practice?

The paper provides a discussion about recent results and perspectives of intertextual analysis — the method that has been a contemporary with Tartu-Moscow school. The connections between the classical philological methods and intertextual analysis are described, together with specifying the concept of intertext and emphasizing the need for the correctness of a researcher, because such an analysis always carries a danger of overinterpretation. Several examples are used to illustrate how the imagination of a (...) researcher can create arbitrary allusions that are not based on the original text and are usually misleading. Many pigmented heterokonts are able to synthesize elements of their cell walls (the frustules) of dense biogenic silica. These include diatom algae, which occupy a significant place in the biosphere. The siliceous frustules of diatoms have species‐specific patterns of surface structures between 10 and a few hundred nanometers. The present review considers possible mechanisms of uptake of silicic acid from the aquatic environment, its transport across the plasmalemma, and intracellular transport and deposition of silica inside the specialized Silica Deposition Vesicle (...) (SDV) where elements of the new frustule are formed. It is proposed that a complex of silicic acid with positively charged proteins silaffins and polypropylamines remains a homogeneous solution during the intracellular transport to SDV, where biogenic silica precipitates. The high density of the deposited biogenic silica may be due to removal of water from the SDV by aquaporins followed by syneresis—a process during which pore water is expelled from the network of the contracting gel. The pattern of aquaporins in the silicalemma, the membrane embracing the SDV, can determine the pattern of species‐specific siliceous nanostructures. This article provides a brief analysis of the life, work, and character of Nikolai Berdyaev. He is described as both a captive and apologist of freedom, and as an influential representative of existential personalism.

Most of the time our utterances are automatically interpreted as speech acts: as assertions, conjectures and testimonies; as orders, requests and pleas; as threats, offers and promises. Surprisingly, the cognitive correlates of this essential component of human communication have received little attention. This book fills the gap by providing a model of the psychological processes involved in interpreting and understanding speech acts. The theory is framed in naturalistic terms and is supported by data on language development and on autism spectrum (...) disorders. Mikhail Kissine does not presuppose any specific background and addresses a crucial pragmatic phenomenon from an interdisciplinary perspective. In this paper, the predicate counterparts, defined both axiomatically and semantically by means of Kripke frames, of the modal propositional logics $\textbf {GL}$, $\textbf {Grz}$, $\textbf {wGrz}$ and their extensions are considered. It is proved that the set of semantical consequences on Kripke frames of every logic between $\textbf {QwGrz}$ and $\textbf {QGL.3}$ or between $\textbf {QwGrz}$ and $\textbf {QGrz.3}$ is $\Pi ^1_1$-hard even in languages with three (sometimes, two) individual variables, two (sometimes, one) unary predicate letters, and a single (...) proposition letter. As a corollary, it is proved that infinite families of modal predicate axiomatic systems, based on the classical first-order logic and the modal propositional logics $\textbf {GL}$, $\textbf {Grz}$, $\textbf {wGrz}$ are not Kripke complete. Both $\Pi ^1_1$-hardness and Kripke incompleteness results of the paper do not depend on whether the logics contain the Barcan formula. (shrink)

I argue against the view that there is intrinsic value in making one's own decisions about the direction and shape of one's life.

The opposition between transcendentalism and naturalism plays a key role in discussions about consciousness at the confluence of phenomenology and analytical philosophy. Associated with it is a whole range of research programs. However, the opposition between transcendentalism and naturalism in these programs is, as a rule, operational and not thematic in nature and presupposes that 1) Transcendentalism and naturalism as traditions are initially alien to each other; 2) The domain of their opposition is ontology. The article attempts to problematize these (...) premises based on one historical circumstance. Turning to the texts of Kant, the founder of transcendental philosophy, I intend to show that transcendentalism, which was first substantiated in them, is a version of naturalistic ontology, that is, a peculiarly interpreted naturalism that identifies nature with its natural scientific model and excludes constituting subjectivity from ontology. It is built not on the naturalization of phenomenology, but on the transcendentalization of natural science. Reinterpreting the experimental method in the spirit of the Copernican turn, Kant substantiates the apodictic nature and lack of alternative to the ontology of nature by turning nature into a correlate of consciousness and strictly limiting the principles of mathematical natural science to the boundaries of the phenomenal world. As a result, the true theme of philosophy—the thing in itself and transcendental subjectivity itself—is taken beyond the boundaries of ontology. The thematization of the naturalistic origins of transcendentalism and the removal of transcendental consciousness beyond the boundaries of ontology, carried out within its framework, thus reveals the problematic nature of these premises. The article also demonstrates that, despite significant differences in the understanding of transcendental philosophy and ontology between Kant and Husserl, the identified motives—the naturalistic nature of the ontological foundation and the meta-ontological character of transcendental subjectivity—remain of fundamental importance for the founder of phenomenology. This allows us to conclude that ontology is not the original domain of confrontation between transcendentalism and naturalism and to substantiate the compatibilist thesis according to which transcendentalism is compatible with ontological naturalism. In this guest column, Epstein offers “a new sign” that, he argues, resolves difficulties that have arisen in many theories and practices, including linguistics, semiotics, literary theory, poetics, aesthetics, ecology, ecophilology, eco-ethics, metaphysics, theology, psychology, and phenomenology. The new sign, a pair of quotation marks around a blank space, signfies the absence of any sign. Most generally, “ ” relates to the blank space that surrounds and underlies a text; by locating “ ” within the text, the margins are brought (...) inside and can become the focus of attention. Not only the margins but also the material background of a text (the page or screen) can be brought forward and focused on through the transparency of the sign “ ”, in which case “ ” becomes a sign of itself. Consubstantial with its medium, therefore, this sign is both relative and universal: “ ” is the same everywhere, on every surface, in every language, and also in the arts. Epstein analyzes works by Rauschenberg, Malevich, Ilya Kabakov, and Vasilisk Gdenov in the visual arts, as well as music by John Cage, to demonstrate the usefulness of his new sign for aesthetics and art criticism. Each discipline, he argues, has its own nonspeakable conditions and assumptions that it needs to bring inside disciplinary frontiers. At the frontier of language, “ ” is both inside and outside, and therefore can express the nonspeakable condition of speakability. In concluding, Epstein suggests that the task of the avant-garde in theory today is to develop a “negative semiotics”: a semiotics of nonsigns, modeled on negative (apophatic) theology. (shrink)

We investigated the perception of developmental changes in timing patterns that happen in the course of second language (L2) acquisition, provided that the native and the target languages of the learner are rhythmically similar (German and English). It was found that speech rhythm in L2 English produced by German learners becomes increasingly stress-timed as acquisition progresses. This development is captured by the tempo-normalized rhythm measures of durational variability. Advanced learners also deliver speech at a faster rate. However, when native speakers (...) have to classify the timing patterns characteristic of L2 English of German learners at different proficiency levels, they attend to speech rate cues and ignore the differences in speech rhythm. Gurvich analyses the degrees of cohesion of various social groups and shows the relationship between group cohesion and the sociality (or sociability) of the individuals who make up these groups. The relationship between the individual and society is the leitmotif of Georges Gurvitch’s work. Beginning from the early Russian-language books on the philosophy of law and ending with the works on sociology published in France and the USA at the final stage of his career, Gurvitch studied the individual person and collective units as interacting sides of the collective social subject. He sought to overcome the struggle between individualism and collectivism which found its ideological expression in the rivalry of the (...) French (Emile Durkheim) and German (Max Weber) schools of sociology. Gurvitch formulated the concept of society as dynamic interaction and mutual determination of the individual and collective unit. In his Russian-language works, written before his emigration, he maintained that it was in the sphere of law that one could determine how the individual and society mutually condition each other and determine the direction of social development. In the late 1920s and early 1930s in his teaching on social law, Gurvitch formulated the concept of sociability which enabled him to focus attention not on the confrontation, but on the interaction of the individual and society. In the concept of “normative fact” he defined the being of society and embodied the dialectical interaction between singularity and multitude. In the late 1930s in his teaching on microsociology, he introduced criteria of sociability, recording individual (intensity of the fusion of individual minds) and collective (the force of social pressure) aspects of the process of social development. Proceeding from these criteria Gurvitch developed a gradation of sociability, expressing it in the scheme “mass — community — communion” which enabled him to analyse the formation of collective units and determine the features of their existence. In his article “Mass, Community, and Communion” (1941) he presented the forms of sociability which enabled him to describe the mutual conditioning of individuals and collective units. Gurvitch’s article spells out the key principles of his philosophy and sociology of law which overcome individualism and collectivism in his account of society. (shrink)

One of the most influential arguments in contemporary philosophy and cognitive science is Chomsky's argument from the poverty of the stimulus. In this response to an essay by Chandra Sripada, I defend an analogous argument from the poverty of the moral stimulus. I argue that Sripada's criticism of moral nativism appears to rest on the mistaken assumption that the learning target in moral cognition consists of a series of simple imperatives, such as "share your toys" or "don't hit other children." In fact, the available evidence suggests that the moral competence of adults and even young children is considerably more complex and exhibits many characteristics of a well-developed legal code, including abstract theories of crime, tort, contract, and agency. Since the emergence of this knowledge cannot be explained by appeals to explicit instruction, or to any known processes of imitation, internalization, socialization and the like, there are grounds for concluding it may be innate. Simply put, to explain the development of intuitive jurisprudence in each individual, we must attribute unconscious knowledge and complex mental operations to her that go well beyond anything she has been taught. This article argues that combining elements of the sociological theories of Johann Arnason and Peter Wagner can contribute to an understanding of the causes of the ‘new Cold War’ on the European continent. Comparisons of today’s confrontation between Russia and the West with the original Cold War are largely misleading since the Soviet model of modernity represented a radical alternative to its liberal western version. Unlike the original Cold War, the current ideological confrontation is not connected with a clash of (...) different forms of modernity. Today’s Russia lacks a clear civilizational identity and does not follow an alternative project of modernity. The recent ‘conservative turn’ in Russian politics largely draws on a specific interpretation of European modernity. (shrink)
